By this personal data privacy policy (hereinafter the « Policy« ), the companies within the OTHRYS HEALTHCARE group (hereinafter the “OTHRYS HEALTHCARE Group”) listed in schedule 1 undertake, in compliance with applicable European and French law, and in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, to ensure the protection of personal data that each of them may be required to collect in the course of its business activities. 

 

The purpose of this Policy is to describe the terms and conditions under which each company within the OTHRYS HEALTHCARE Group, acting in its capacity as data controller, collects and processes certain personal data, whether directly or indirectly (hereinafter the « Data« ).

  1. Scope of the Policy

 

This Policy applies when you: 

  • visit the websites published by any company within the OTHRYS HEALTHCARE Group, a list of which is set out in schedule 2 (hereinafter the « Websites« ); 
  • create a user account via « Pegase connect » granting you access to the entire content of all the Websites; 
  • log into your user account via « Pegase connect » to access the entire content of all the Websites; 
  • attend any professional event organised by any company within the OTHRYS HEALTHCARE Group; 
  • fill in any form available on the Websites; 
  • contact the customer service of any company within the OTHRYS HEALTHCARE Group; 
  • provide your email address to receive our newsletters. 

 

 

  1. Nature of the collected and processedData 

 

Each company within the OTHRYS HEALTHCARE Group collects and processes only Data that is adequate, relevant, kept up to date, accurate and limited to what is necessary for the purposes of its business. 

 

Without the following list being exhaustive, the main Data directly collected and processed is as follows: 

  • your surname(s), first name(s) and identifier(s); 
  • your date of birth; 
  • your profession; 
  • your RPPS number ; 
  • your postal address; 
  • your courriel address; 
  • your telephone number(s). 

 

Our newsletters may contain audience measurement trackers in two (2) distinct forms: 

  • tracking pixels, embedded within the body of the message, used to measure the open rate of our newsletters, to determine whether the message has been viewed, to compile aggregated statistics on the performance of our campaigns, and to improve the content, frequency and relevance of the communications sent to you. The only Data collected for this purpose is your IP address and the date and time the message was opened. 
  • click-tracking links, based on a redirection technology provided by our service provider Mailjet, which are triggered only when you click on a link contained in the newsletter. They allow us to measure click-through rates and to identify the content or offers generating the most interest. The only Data collected for this purpose is the link clicked and the date and time of the click. 

 

These trackers are only implemented, with your prior consent, to receive our newsletters and to measure their performance; consent you may withdraw at any time under the conditions set out below (6. « Your rights« ). 

 

 

  1. Purposes and legal bases for the processing of Data

 

Each company within the OTHRYS HEALTHCARE Group processes your Data only for specified, explicit and legitimate purposes and on the following legal bases: 

 

To manage our business relationship (management of subscriptions and registrations, monitoring of the customer relationship, payment monitoring)

  • service providers acting on behalf of the companies within the OTHRYS HEALTHCARE Group (including technical service providers, online payment service providers and other service providers);  
  • advisers of the companies within the OTHRYS HEALTHCARE (including legal counsel and external auditors);  
  • authorised French and/or foreign authorities, including in connection with judicial or administrative proceedings;  
  • certain business partners, subject to your prior consent where required;  
  • third parties in connection with a sale, merger, acquisition, corporate restructuring, reorganisation or other corporate transaction involving all or part of our business. 

 

 

  1. Data retention period

 

Your Data is retained only for as long as is necessary to fulfil the purposes for which it was collected, in accordance with the main indicative retention periods set out below: 

 

User account management and management of the contractual relationship 

Retention period: For the duration of the contractual relationship and for five (5) years following the termination or expiry of the contract, or for such longer period as may be permitted or required under applicable law. 

 

Commercial and accounting records 

Retention period: Ten (10) years from the end of the relevant financial year. 

 

Marketing and commercial prospecting 

Retention period: Up to three (3) years from your last active contact with us. 

 

Data processed for evidential purposes in the event of a dispute 

Retention period: For the duration of the applicable statutory limitation periods. 

 

 

 

 

  1. Your rights

 

In accordance with applicable law, you have the following rights: 

  • Right of access: you may obtain information concerning the processing of your Data as well as a copy of such Data; 
  • Right to rectification: if you consider that your Data is inaccurate or incomplete, you may require that it be corrected accordingly; 
  • Right to erasure: you may require the erasure of your Data, to the extent permitted by applicable law; 
  • Right to restriction of processing of the Data; 
  • Right to object to the processing of the Data. In particular, you have an absolute right to object to the processing of your Data for the purposes of direct marketing; 
  • Right to data portability, allowing you to retrieve certain of your Data or, where technically feasible, to have it transferred to a third party. Each company within the OTHRYS HEALTHCARE Group will endeavour to respond to your request within a reasonable time and, in any event, within the time limits set by applicable law; 
  • Right to issue directions regarding the retention, erasure or disclosure of Data following your death; 
  • Right to withdraw your consent to the processing of your Data at any time. 

 

Where the processing of your Data is based on your consent, you may withdraw your consent at any time. Withdrawal of your consent will not affect the lawfulness of any processing of your Data carried out on other legal basis, such as where processing is necessary for the performance of your subscriptions or registrations, in accordance with applicable law. 

If you no longer wish to receive our newsletters, you may withdraw your consent at any time by clicking the unsubscribe link included in each newsletter.

Your Data is processed in France. However, for the purposes described in this Policy, the companies within the OTHRYS HEALTHCARE Group may engage certain service providers located outside France or service providers that themselves rely on subcontractors located abroad, including outside the European Economic Area (hereinafter the « EEA« ), in countries whose data protection laws may differ from those applicable within the EEA. 

 

In such cases, the companies within the OTHRYS HEALTHCARE Group will take the necessary measures with their processors and partners to ensure an adequate level of Data protection in accordance with applicable law. Where your Data is transferred to a country that does not offer an adequate level of protection, the companies within the OTHRYS HEALTHCARE Group undertake to govern the transfer by way of appropriate safeguards.

Each company within the OTHRYS HEALTHCARE Group ensures that your Data is processed securely and confidentially, including where certain operations are carried out by processors. To this end, each company within the OTHRYS HEALTHCARE Group undertakes to implement all physical, organisational and logistical measures necessary to prevent the loss, alteration, misuse and destruction of the Data, in particular by ensuring secure access limited to persons authorised to process it.
